    • Theoretical Training (an e-book provided to the trainee upon registration)

    • Confined Water Training (skill development)

    • Open Water Training (practical application of information and skills)

  • Service (Service): refers to all services (sales – rental – training – trips) within the field of diving.

  • Blue Circle Website: is a private electronic platform providing (trips, activities, maritime events, and training courses in recreational and technical diving, and gas blending).

  • The Client or Trainee: is the person contracting with the “Blue Circle” website to purchase (trip services, activities, maritime events, and training courses in recreational and technical diving, and gas blending).

  • The User: means every individual who accesses the “Blue Circle” website and electronic platform and accepts the site’s terms and the services provided (trips, activities, maritime events, and training courses in recreational and technical diving, and gas blending).

  • Terms and Conditions: refers to these terms and conditions of the Blue Circle website, which may be subject to amendment or change from time to time.

Lawful Use of the "Blue Circle" Website

  • The “Blue Circle” website is available only to users with full legal and legitimate capacity to contract and conduct business with it.

  • The legal age to use and request subscription to the services provided by the (Blue Circle) website, including (trips, activities, maritime events, and training courses in recreational, technical, and gas-blending diving), is (18) eighteen years.
    By entering and using the “Blue Circle” website, you acknowledge and agree that you possess full legal capacity.

  • For users under the age of eighteen, mandatory guardian consent is required to subscribe to the services provided by the website, including (trips, activities, maritime events, and training courses in recreational, technical, and gas-blending diving).

  • The user is considered fully responsible for maintaining the confidentiality of their account password and for all activities that occur under their account.

Training Course Registration Terms and Conditions:

4. The user must complete all training, exercises, and prerequisites specific to the programs and courses before starting the actual training.
5. The user is not entitled to enter the training program or course after paying fees and registering except after obtaining approval from the Blue Circle Center.

Sea Trip Registration Terms and Conditions:
  1. Blue Circle Trading Establishment, its instructors, or affiliates are not responsible for trip cancellations due to force majeure, weather conditions, equipment failure, inability to obtain permits, or any reason beyond the establishment’s control. Participants are not entitled to claim any compensation for delayed or canceled trips.
  2. The participant acknowledges exposure to risks of injury, which may lead to death, through participation in the trips.
  3. The participant agrees to bear responsibility for all damages to equipment they use and assumes all risks of injury or death resulting from their non-compliance with instructions provided by Blue Circle instructors or affiliates.
  4. The participant acknowledges voluntary participation and is personally responsible for the outcomes of this participation.
  5. Blue Circle Trading Establishment, its instructors, or affiliates are not responsible for any physical or mental injury, illness, or death that may occur during the trip.
  6. The participant acknowledges providing a waiver regarding information about the trip organizer or supervisor that might hinder the implementation of the trip program.
  7. The participant is committed to being present at the specified time. In case of non-attendance on time, the establishment has the right to proceed with the trip without them, and the participant cannot claim any compensation.
  8. The participant bears full responsibility for their luggage and belongings. In the event of loss, damage, or sinking of items, they are not entitled to claim any compensation from the establishment.
  9. The participant must adhere to the dive trip dates and hours specified on the site and must attend without delay.
  10. The participant agrees to comply with and accept all guidelines, policies, and instructions related to the dive trip and the trip supervisor.
  11. The participant is solely responsible for all actions or errors that may result in damage to the “Blue Circle” website or any third party.
  12. The participant is not entitled to arrive late, interrupt the dive trip, or request a change in trip dates or supervisors.
  13. The participant is committed to following diving standards and the limits of the license they hold, and must not exceed diving times.
  14. Blue Circle Establishment reserves the right to apply additional fees for water games/sports.

Prices
The website reserves the right to change the prices of training courses or sea trips at any time, and new prices shall be effective from the date they are published on the website.
Medical Disclaimer (for Courses, Programs, and Trips)
  1. The trainee is committed to consulting a physician before starting any diving training course, program, or sea trip, and must be in good health to participate.
  2. The trainee acknowledges awareness of the risks of injury, which may lead to death, through participation in any diving training course, program, or sea trip.
  3. The trainee agrees to undertake the training course or sea trip voluntarily and assumes sole responsibility for all risks of injury or death, while indemnifying Blue Circle Establishment from any claim or allegation of any kind.
  4. The trainee acknowledges that they are participating voluntarily in the training program or sea trip and is personally responsible for the outcomes of this participation.
  5. Blue Circle Establishment, its instructors, or affiliates shall not bear responsibility for any physical or mental injury or illness that may result for the trainee as a result of participation.
  6. Directly or indirectly, regarding any athletic training plans or exercises we recommend: while we may provide guidance such as written descriptions, images, or videos describing how to perform specific exercises or activities, you bear the responsibility of performing these exercises or activities correctly. There is a risk of injury or exacerbation of illness if exercises or activities are practiced incorrectly.
  7. The trainee acknowledges that they will not withhold any information from their instructor that may hinder the instructor’s ability to provide appropriate guidance and advice, and the trainee bears full responsibility for any consequences that may occur.
  8. All forms signed by the trainee upon subscribing to training courses are binding, in accordance with the requirements and conditions of PADI International and the Saudi Water Sports & Diving Federation.
Regarding Training Course Results
  1. There are no guarantees regarding the level of success you can achieve, and Blue Circle Trading Establishment agrees that results will differ from one individual to another.
  2. The success of each individual in reaching the desired results depends on their commitment and motivation. Your results may vary and are based on many variables, including, but not limited to, the performance of the individual instructor, the trainee’s life experience, personal and genetic health, starting point, expertise, as well as the trainee’s adherence to instructions and guidelines during the training course.
Diving Trip Results Disclaimer
  1. There are no guarantees regarding the level of success you may achieve during the trip, and Blue Circle Trading Establishment agrees that results will vary from one individual to another.
  2. The success of each individual in reaching the desired results depends on their commitment and motivation. Your results may vary and are based on many variables, including, but not limited to, the participant’s individual performance during the trip, their life experience, personal and genetic health, starting point, expertise, as well as the participant’s adherence to instructions and guidelines during the diving trip.
Order Termination and Cancellation (for Courses, Training Programs, or Sea Trips):
  1. Blue Circle Trading Establishment has the right to terminate the course, training program, sea trips, or any activities provided by the diving center in the event of any force majeure that prevents completion. Force majeure includes, but is not limited to: – Floods, torrents, storms, earthquakes, disasters, and any act of God that prevents the continuation of training or the sea trip without any other similar acts of nature. – Failure of the Blue Circle website establishment to provide services to the beneficiary despite their compliance with laws, or failure to adhere to what is reasonably available. – The participant’s failure to comply with regulations and instructions, resulting in the failure to complete attendance of the training activity, programs, sea trip, or courses.
  2. Blue Circle Trading Establishment has the right to terminate the subscription in the course, training programs, or sea trip and cancel its contract with the trainee if any of the following cases occur: – If the participant in the course, program, or sea trip violates the rules and regulations applicable at the site designated for training or the sea trip. – If the participant engages in behavior that contradicts public morals and ethics during training or the sea trip at the designated site.
  3. If the participant fails to attend (the training course or program) for a period of 60 days, their right to complete the training course is forfeited, and they are not entitled to claim the value of the training course fee.
  4. After the start of training programs and the completion of any part of the theoretical, pool, or sea training, the participant is not entitled to cancel or claim the value of the training course fee.
  5. In the event that the trainee was medically accepted but became medically unfit for any reason during the implementation of the training, their right to complete the training course is forfeited, and they are not entitled to claim the value of the training course fee.
  6. In the event that the trainee does not pass the theoretical, pool, or sea test, the trainee shall bear the cost of an additional training day to complete the training, and they are not entitled to cancel or claim the value of the training course fee.
Exchange and Refund Policy:

  2. No exchange or refund will be provided once training for any part of the training course has commenced.
  3. Exchange or refund is permitted in the event of health problems that appear while the trainee is in confined or open water.
  4. No exchange or refund will be provided if the trainee violates instructions, regulations, or laws.
  5. No exchange or refund will be provided in the event of failure to attend the training site without an excuse acceptable to the Blue Circle management.
  6. The order value will be exchanged or refunded if the invoice amount was higher than required due to an error.
  7. Exchange or refund of the order value is permitted in the event of a health condition (for example, ear equalization issues), provided a medical report explaining the condition is attached before the start of the training process.
  8. An exchange or refund of 25% of the basic amount is permitted after registration and receipt of educational materials, but before the start of the training process.
  9. The order value may be exchanged or refunded for any other reason accepted by the Blue Circle website management.
Payment Methods:

The “Blue Circle” website accepts payment through the payment methods available on the site.

Terms and Mechanism for Handling Refund Requests:
  1. The amount will be refunded using the same payment method only, or as decided by the website management.
  2. The “Blue Circle” website is not responsible for any additional fees or transfer charges in the case of a refund; the user bears these fully, and they will be deducted from the refunded amount.
  3. The user is committed to attaching the necessary information requested by the “Blue Circle” website, including the username, order value, details, and any additional information.
  4. The “Blue Circle” website has the right to reject a refund request if it violates the refund policy.

Intellectual Property:

All intellectual property rights, trademarks, names, and designs, as well as all information, designs, graphics, writings, icons, images, videos, music, sounds, interfaces, symbols, and software, in addition to their selection and arrangement, are the exclusive property of the Blue Circle website. They are specifically subject to legal protection under copyright and trademark protection regulations and related laws, and are governed by the laws of the Kingdom of Saudi Arabia and international agreements.

Governing Law and Dispute Resolution:

Any contractual or non-contractual obligations arising from or related to this agreement in any way shall be interpreted and governed by the laws applicable in the Kingdom of Saudi Arabia. In the event of any dispute between the two parties regarding the implementation or interpretation of this agreement, the competent courts in the city of Jeddah, Kingdom of Saudi Arabia, shall be the authority specialized in resolving the dispute.
